Early this year Image Skincare launched a lawsuit against three major online retailers. There is an awareness in the skin care industry that clients have been purchasing professional products online from unauthorized retailers for quite some time.
What is the difference between authorized and unauthorized dealers? Only licensed professional skin care experts such as estheticians and medical practitioners are authorized. Let me start with an explanation about what professional skin care really is. The FDA regulates certain products including skin care. Professional skin care products also known as cosmecueticals contain ingredients that are potent enough to be absorbed deeply and change skin at a cellular level. Skin care that is NOT considered professional, is OTC (over the counter) and can only penetrate the top dead skin layers, and can be sold by anyone. These are items that you will find at mall store beauty counters, drugs stores, on celebrity endorsed infomercials and multi level marking companies. If you aren't sure what the last on is...you have probably been approached to buy something and then told you will get a much better deal if you just buy the kit and sell a few pieces to friends and family.
I have looked online for pro products and have seen all kinds of things from the most recent products, to products that have been out of production since 2008. I’ll do the math for you, that’s a product that is 9 years old!
I would be remiss if I didn’t share some of the concerns. I have discussed this at length with other professionals and Image account execs. Some of the claims are that products being advertised as “Image Skincare” products from unauthorized dealers are actually expired, rancid, chemically altered, watered down or otherwise tainted.
The way professional skin care companies operate, such as Image or any other professional line, is by entrusting the sale of their product to licensed skin care professionals. They do not sell to middle men, retailers, multi level marketers, or anyone else who is not licensed to practice skin care. Skin care lines require a contract and in the terms of the contract it’s emphatically declared that the items are not to be resold to 3rd party retailers to be or, sold online. Their goal is to make sure that the product is used as directed and that the integrity of the product and the brand is represented and cared for by licensed professionals including Estheticians and Medical Practitioners. Here is an excerpt from the contract that is required to sell Image.
(i) are an aesthetician, registered nurse, physician, physician assistant or other professional certified by your relevant state professional and regulatory authority, that may, by virtue of your certification, apply our Products on your clients or patients; (ii) are purchasing our Products for your application of such Products on your clients or patients as a service in exchange for a service fee; (iii) will only sell our Products to individuals that you believe are purchasing our Products for their personal use or the use of their friends and family; (iv) will only sell our Products in quantities that are reasonable for an individual’s personal use and not for resale; (v) will only sell our Products to individuals you reasonably believe are located within the United States; (vi) will only sell our Products at your place of business as designated by you in your Account; (vii) will not sell our Products online on any website without our prior written approval, which we may grant or deny in our sole and absolute discretion, and which may be subject to separate terms and conditions; (viii) will only sell our Products to end users of the Products and not to parties that resell our Products, or can be reasonably anticipated to resell our Products; (ix) will use our Products only in a lawful manner and otherwise in compliance with these Terms; and (x) have the capacity to be bound by these Terms.
